Please read this document carefully before proceeding. This is a legal document which affects your legal rights. By checking the box below, you acknowledge that you have read, understood, and agree to the terms of this waiver.

1. Acknowledgment of Risks:
   I, the undersigned participant, acknowledge that my participation in the "Run with Jawon - The Biggest 100 Meter Race in PA History" (the “Event”) involves inherent risks, including but not limited to the risk of physical injury, permanent disability, or death, and property damage. These risks may be caused by my own actions or inactions, the actions or inactions of others participating in the Event, the conditions in which the Event takes place, or the negligence of the Organizer.

2. Assumption of Risks:
   I voluntarily assume all risks related to my participation in the Event, whether known or unknown, foreseeable or unforeseeable, and accept full responsibility for any injury, damage, loss, or expense that I may suffer as a result of participating in the Event.

3. Release and Waiver:
   In consideration of being permitted to participate in the Event, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and covenant not to sue Struggle to Succeed Fitness LLC, its officers, directors, employees, volunteers, agents, and representatives (collectively, the “Released Parties”) from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that I may sustain while participating in the Event, whether caused by the negligence of the Released Parties or otherwise.

4. Indemnification:
   I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, expenses, including reasonable attorney’s fees and costs, arising out of or in connection with my participation in the Event.

5. Medical Treatment:
   I consent to receive medical treatment that may be deemed advisable in the event of injury, accident, or illness during the Event. I understand and agree that I am solely responsible for all costs related to such medical treatment.

6. Fitness to Participate:
   I certify that I am physically fit and have not been advised otherwise by a qualified medical professional. I acknowledge that it is my responsibility to consult with a physician prior to and regarding my participation in the Event.

7. Publicity Release:
   I grant permission to Struggle to Succeed Fitness LLC to use my image, likeness, name, and voice in any photographs, videos, or other recordings of the Event for any legitimate purpose, including but not limited to promotional and marketing materials, without compensation or further notice.

8. Governing Law:
   This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles.

9. Severability:
   If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
